In nearly all circumstances, Mediation is far less costly than Litigation. Allow me to context the two.
A litigated divorce agreement can cost you and your spouse anywhere from $20,000 to $50,000 for a relatively simple case settled out of court, and upwards of several $100,000 if you end up in a trial on one or several of the issues that will need to be resolved. A litigated divorce can also last one or more years to be finalized. Again with litigation, you will typically have to pay a non refundable retainer for your lawyers which can range from $5,000 to $15,000 for each of you. If you do end up in a trial, charges will accumulate very quickly using up many of the funds that would otherwise be available for you and your children.
A mediated divorce agreement on the other hand, will typically only cost you $2,000 to $5,000 for both of you combined, depending on the number of hours in mediation sessions, and can be worked out in a matter of weeks or months depending on the frequency of the sessions. There are typically no retainer fees in mediation.
In my Mediation practice, I charge an hourly fee which is usually shared between the parties. Each session may last 1 to 2 hours. On average it takes 3 to 6 sessions, depending on the circumstances and the issues that have to be worked out. Sessions are paid as you go. In either litigation or mediation, there is also a fee to draft the Settlement Agreement also called Separation Agreement in addition to the filing of the document in the court in order to obtain the divorce.
